Who you are agreeing with. Why'd You Say That? is an independent party game operated by a sole trader based in Antigua and Barbuda, trading as Why'd You Say That? Contact: support@whydyousaythat.com. The operator's full legal name and postal address are given on request to that address, and appear on the Paddle receipt for any purchase. Paddle.com Market Ltd is the merchant of record for every sale and is the seller named on your receipt.
Who can play
The game is for players aged 13 and over. If you are in the United Kingdom, the European Economic Area, or another country whose law sets a higher age for processing this kind of information without a parent's permission, you must be at least 16. Purchases may only be made by someone aged 18 or over, or with the permission of a parent or guardian who accepts these terms.
Using the game
By using the game, you agree to use it lawfully and respectfully in text and in room voice. Do not harass people, expose private information, automate traffic, evade moderation, interfere with rooms, or attempt to access another player's session.
Party-game content
Players create spoken conversation, chat, evidence, and questions. The host and players are responsible for choosing an appropriate group and prompt settings. Leave or report a room if the conversation becomes unsafe or unwelcome.
You keep whatever rights you have in the text you type. By submitting it, you grant a worldwide, royalty-free licence to store, display, and transmit it to the other people in your room for as long as the round runs, and to operate, moderate, and debug the service. If you deliberately submit content for publication in the game, such as a prompt sent through a submission feature, that licence also covers publishing, adapting, and distributing it as part of the game, with no obligation to use it and no payment. Do not submit anything you do not have the right to license this way.
If you choose Join voice, you give the game permission to capture your microphone and transmit that audio live to the other active players through Cloudflare Realtime for the duration of that voice session. Voice is not recorded or transcribed by the game. You can mute, deafen, or leave at any time.
Cosmetics
Paid items are cosmetic only. They do not improve missions, scores, station access, matchmaking, or secret information. A purchase grants a personal, revocable license to use the included collection in the game; it does not transfer ownership of the artwork or service.
Availability
The game may change, experience maintenance, or be discontinued. Reasonable care is taken, but uninterrupted availability is not guaranteed.
Enforcement and appeals
A room host, and any moderator the host authorises, may mute a participant's room voice or remove or ban a player from their own room. That decision belongs to the host and is limited to that room. Any player can report another from the room menu, including for voice abuse; a report goes to that room's host and moderator with recent public chat and whether the reported player was in voice, but never a voice recording. The privacy page describes exactly what it contains.
Abuse, payment fraud, or attempts to compromise the service may result in removal from the service or revoked access, decided by the operator. Where it is reasonable to do so, you will be told what happened and why. To contest a removal or a revocation, write to support@whydyousaythat.com with the room code or transaction ID and what you believe went wrong; a reply will be sent within 30 days. Access revoked because a payment was refunded, reversed, or disputed is restored if the payment is restored.
Intellectual property
The game, its name, artwork, written prompts, and code belong to the operator or its licensors, apart from third-party components used under their own licences. You may stream, record, and monetise your own recordings of your own sessions. You may not resell, redistribute, or reproduce the artwork, prompt content, or code outside the game.
If you believe something in the game infringes your copyright or trade mark, write to support@whydyousaythat.com identifying the work, where it appears in the game, and your contact details. Reported material is reviewed and removed where the report is valid.
Changes to these terms
These terms may be updated as the game changes. The effective date at the top of this page always shows the current version. Where a change materially reduces your rights, a notice will be shown in the game before it takes effect. Continuing to play after that date means the updated terms apply. A change never applies retroactively to a purchase already made.
Disclaimer and liability
The service is provided as available to the extent permitted by law. To the extent the law allows, the operator is not liable for indirect or consequential loss, lost data, lost profit, or anything said or done by other players in a room. Where liability cannot be excluded, it is limited to the amount you paid for the game in the twelve months before the claim, which for a free player is nothing.
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot legally be limited. These terms do not remove consumer rights that cannot legally be waived.
Governing law
These terms are governed by the law of Antigua and Barbuda, and its courts have jurisdiction. If you are a consumer resident elsewhere, you keep the protection of the mandatory consumer law of the country you live in, and you may bring proceedings there.
